  • Marin and Sonoma County real estate holdings with complex issues over real estate and business joint venture with third party non-marital business partner involving Uniform Partnership Act (UPC) and hidden and laundered assets.
  • Registered Nurse terminated from employment at hospital, accused of 30 counts of mishandling narcotics, and blamed for systems failures by hospital and charged by the Board of Registered Nursing Department of Consumer Affairs State of California with Grossly Incorrect and/or Grossly Inconsistent Entries in Patient Records, and, Unprofessional Conduct -Gross Negligence and, Unprofessional Conduct -Incompetence. Case was prosecuted by the California Attorney General California Department of Justice. R.N. cleared and found factually innocent by judge after full administrative trial and clear R.N. license status restored.
  • Private mediation. An administrative civilian employee at public safety agency terminated for insubordination against command staff officer. Resolved through private mediation reinstating employment status and clearing record.
  • Trust-fraud case where elder bilked out of her money through conspiracy involving husband and property transferred to non-family member. One half community property interest recovered per court trial judgment.
  • Trust-estate case settled at mediation where co-trustee beneficiary tried to deprive other two co-trustee beneficiaries of $145,000 through miss-characterization of a loan.
  • Trust accounting and breach of fiduciary duty actions on Board of Trustees in winding down 680-plus beneficiary Native American Land Trust with competing factions of beneficiaries resulting in Board resignation and rulings related to control and management of land. Subsequently brought court wind-down proposal for land trust on California Civil Code, § 815.3 authorizing federally recognized Indian Tribal government to acquire and hold conservation easement.

  • United States District Court for the Southern District of California. Diversity case in the County of San Diego involving Attorney Malpractice where defendant attorneys were negligent in handling case against County of San Diego involving severe psychotherapist/patient sexual abuse. Settled in client's favor.
  • United States District Court for the Norther District of California. Terminated fire captain, violation of 14th Amendment procedural due process defective Skelly Hearing. Appeal of Skelly Hearing non-binding arbitration over ruled Skelly Hearing termination. Fire Department refused to rehire firefighter. Case filed in United States District Court. Ruling in favor of terminated fire captain granting summary judgment in favor of fire captain on procedural due process. Federal Judge Walker ordered fire Captain to private mediation presided over by retired California Court of Appeals Judge. Judge ruled against firefighter. Federal Judge Walker overturned retired California Court of Appeals Judge's adverse decision after arguments that the ruling was defective. Defense defeated on its subsequent summary judgment motion on wrongful termination, resulting in settlement with damages paid to Captain and his file cleared of wrongdoing, badge returned.   • United States District Court for the Northern District of California federal due process action filed against the County of Monterey settled building code issues, allowing the completion of a building project which had been delayed by citations and "red-tape" depriving a family of living at their residence (semi-rural ranch home with horses and livestock) for two years.
  • Skelly Hearing terminated firefighter accused of on-duty theft charges unsubstantiated and cleared, fire department forced to hold second Skelly Hearing as a result of a due process defect in first Skelly Hearing. Termination reversed and firefighter returned to work at previous status.
  • Civil Code 526(a) Tax payers lawsuit against Mendocino County District Attorney Norman Vroman large scale mishandling of asset forfeiture funds. (See press media article on-line).
  • Employment law case against major San Francisco personal injury law firm settled involving miss-characterization of an employee as an independent contractor causing harm due to deprivation of medical insurance benefits.
  • Breach of sales contract for sale of winery with attendant employment issues to off-shore buyer settled.
  • Misrepresentation case against a real estate broker and seller of a restaurant business involving misrepresented expenses and "puffed" income settled out of a court after filing lawsuit in Sonoma County Superior Court.
  • Dissolution and wind-down of multiple commercial real estate limited liability companies (LLC) involving breach of fiduciary duty. Claims were made that the financials were "fabricated". Settled at court ordered mediation on the eve of trial.
  • Dissolution and wind-down of residential real estate developer LLC with off-shore principal settled out of a court after filing lawsuit in San Mateo County Superior Court.
  • Firefighter misconduct allegation settled after procedural (Skelly) irregularities exposed.
  • Sonoma County red tag building code fine issue settled at mediation on the eve of a scheduled trial. A retired elderly couples building code violations fines on their property accrued from 2007 through 2014, was reduced from $278,000 to $19,500 and the outstanding allegations of the violations resolved.
  • United States District Court for the Northern District of California represented government entity against industrial violator pursuant to the Clean Water Act (CWA) and Resource Conservation and Recovery Act (RCRA) where serious and systemic discharges of pollutants placed wild life, fishery and human health at risk. Violations ceased and case settled.
